PFAS

C–F ≈ 485 kJ/mol — the strongest single bond in organic chemistry. Nothing in a river, a liver or a landfill is strong enough to break it.

A family of more than 10,000 man-made chemicals that make things repel water, oil and stains — and then never leave. This is what they are, how the rules actually came into force, and what your role is on Monday morning.

What it actually is它到底是什么

One definition, not five

PFAS are substances containing at least one fully fluorinated carbon atom — the OECD 2021 working definition, and the basis for most regulatory text. Different laws draw the boundary slightly differently: the EU restriction dossier, the US state statutes ("intentionally added PFAS"), and drinking-water rules each list different subsets. Pick one definition for your own company, write it into your RSL, and apply it globally. Most compliance failures start as definition failures.

The useful mental model: PFAS is not a chemical, it is a design strategy — fluorine is bolted onto a carbon backbone precisely because nothing can pull it off. The performance and the persistence are the same property.

Where it hides in a real product

Durable water repellent (DWR) finishes; ePTFE and other membranes; coatings and laminates; printing inks and pigments; adhesives; thread and zipper lubricants; mould-release agents on hardware and buckles; anti-mist agents in chrome plating; grease-proof paper and food packaging; fluorinated HDPE containers; firefighting foam on your own site; even machine lubricants and cleaning agents in the factory.

Notice how many of these are things a brand never buys directly. That is the whole difficulty.

Nothing here happened suddenly. Each step is evidence → treaty or dossier → consultation → opinion → adoption → transition period → enforcement. Reading the sequence is what lets you predict the next one instead of reacting to it.

3M withdraws PFOS chemistry

Not a law — a company reading its own blood-monitoring data. Voluntary exit is usually the first signal that regulation is coming.

US EPA PFOA Stewardship Program

Eight major manufacturers commit to a 95% reduction by 2010 and elimination by 2015. Voluntary, sector-wide, and it worked well enough to prove the substances were replaceable.

PFOS listed under the Stockholm Convention

The universal restriction dossier

Five authorities — Germany, Denmark, the Netherlands, Norway and Sweden — submit a REACH restriction proposal covering the whole PFAS group. ECHA publishes it on 7 February 2023. The logic changes from "ban a molecule" to "justify a use".

Liability arrives in the United States

April 2024: EPA finalises the first national drinking-water limits (PFOA and PFOS at 4 parts per trillion). Days later, PFOA and PFOS are designated hazardous substances under CERCLA — which means clean-up liability, and it travels back up the chain to whoever put it there.

State law starts biting first

Minnesota's Amara's Law bans intentionally added PFAS in eleven product categories from 1 January 2025, with a broad 2032 ban. California AB 1817 restricts PFAS in textile articles from 1 January 2025. Maine's staged bans follow. In practice, US state law — not the EU — is what pulls your product off a shelf first.

Opinion, adoption, transition

RAC and SEAC are issuing sector-by-sector opinions on the universal restriction; adoption is followed by a transition period (typically 18 months) plus derogations of roughly 5–12 years for uses with no alternative. Plan against the transition dates, not the headline date.

Five ideas explain almost every PFAS rule written in the last five years. If your team understands these, they can read a new regulation without you.

Principle 01

Persistence is itself the hazard

Classic risk assessment asks "how toxic, at what dose". For a substance that never degrades, exposure can only accumulate — so the regulator stops arguing about dose and regulates the persistence.

传统风险评估问的是"多毒、多大剂量"。但对一种永不降解的物质,暴露量只会不断累加——因此监管者不再纠缠剂量,而直接管控"持久性"本身。

Principle 02

Group control stops the whack-a-mole

Ban C8, industry moves to C6; restrict C6, it moves to C4. Each move costs everyone a full re-qualification cycle and buys 18 months. Regulating the group is cheaper for industry than three sequential substitutions.

禁 C8,行业转 C6;限 C6,再转 C4。每一次转换都要走完整的重新认证周期,却只换来 18 个月。整组管控,对产业而言反而比连续替代三次更省钱。

Principle 03

Essential use, not convenient use

The question is no longer "is it safe enough" but "is this use necessary for health, safety, or the functioning of society, with no alternative available". Medical devices and semiconductors answer differently from a stain-resistant sofa.

Principle 04

Liability follows the molecule home

CERCLA designation, water-utility clean-up costs and private litigation all attach to whoever introduced the substance. A compliance line item today is a balance-sheet item tomorrow.

Principle 05

The market always moves before the law does

Retailer requirements, insurers, investors, NGO testing and consumer claims arrive years ahead of the enforcement date. By the time the legal deadline lands, the commercial deadline has already passed. Build to the market signal, then compliance is a by-product.

Who does what各角色的具体动作

Four tiers, one chain. Each list below is written so it can be handed to that team as-is — verbs, owners, evidence.

  1. Own the definition and the threshold. Write one PFAS clause into your RSL — definition, scope, limit values, test method, effective date — and apply it in every market, not per-country.

  2. Map exposure at BOM level, not product level. One garment can carry PFAS in the face fabric, membrane, print, adhesive, thread lubricant, zipper and the polybag. A product-level "yes/no" is not data.

  3. Sequence the phase-out with dates and named owners per material family — not one company-wide slogan. Publish the sequence to suppliers 12–18 months before you need it.

  4. Treat lost performance as a design problem. Non-fluorinated DWR wets out sooner — so re-spec seam placement, face-fabric construction, lining, and the care instruction. Chemistry alone cannot recover the spec.

  5. Decide the claim language before marketing does. "PFAS-free" is a legal claim. "No intentionally added PFAS; total organic fluorine below 50 ppm by CIC" is a defensible statement.

  6. Pay for the transition. Cost-share the testing, commit volume, extend PO horizons. A factory cannot purge and re-qualify a coating line on a 30-day order.

Real-world example

A brand switched every jacket to a non-fluorinated DWR and still failed a retailer's screening at 8 ppm fluorine. The chemistry was clean. The padder bath, the stenter and the shared subcontractor were not. The fix was not a new supplier — it was a written purge protocol plus first-run verification testing.

  1. Put it in the contract, not the newsletter: named RSL/MRSL version, declaration of conformity per shipment, right to test, right to audit sub-tiers, remedy and cost-allocation if a lot fails.

  2. Build a chemical inventory at every wet-processing and coating site — CAS numbers, SDS, purchase invoices — and reconcile that inventory against your test results. Inventory and testing catch different failures.

  3. Screen broad, confirm narrow. Use total organic fluorine by combustion ion chromatography as a cheap gate, then targeted LC-MS/MS only on the hits. This is what makes a full-portfolio programme affordable.

  4. Prioritise by process risk: wet processing and coating first, then trims and hardware, then packaging. Do not spread the budget evenly — spread it by likelihood.

  5. Require segregation: dedicated lines or tanks where possible, a documented purge SOP where not, and verified first-run release testing after any changeover.

  6. Approve the formulation, not the promise. Maintain a positive list of approved chemical products by formulator, trade name and version — and lock it against silent reformulation.

  7. Keep one evidence pack per material: declaration, SDS, test report, method, limit of detection, date, and the lot it links to. If you cannot produce it in an hour, you do not have it.

  1. Inventory every chemical inside the fence — including auxiliaries, machine lubricants, cleaning agents, and anything a subcontractor carries in. The drum nobody logged is the one that fails you.

  2. Demand formulation-level declarations from your chemical vendors, plus ZDHC MRSL conformance and a fluorine statement. A sales sheet saying "C6-free" is marketing, not evidence.

  5. Train the operator who actually opens the drum, in the local language, in thirty minutes, with photographs. Compliance fails on the shop floor, not in the office.

  6. Declare deviations early. An early disclosure is a problem to solve together; a late discovery is a recall, a chargeback and the end of the relationship.

  1. Disclose to CAS level — under NDA or through a third-party verifier if the formula is confidential. "Confidential" is an acceptable answer only if it comes with test data.

  2. Supply total fluorine / total organic fluorine data on the product as shipped, with the method and detection limit stated. Data without a method is a number, not a result.

  3. Prove the alternative, don't just offer it: wash cycles, spray rating, abrasion, ageing — and confirm it does not trade one RSL problem for another (siloxanes, isocyanates, microplastics).

  5. Operate change control. Notify every customer before shipping any reformulation, however minor. Silent reformulation is the single most common cause of a late, expensive failure.

How the brand builds readiness品牌如何带动能力与准备度

You cannot audit your way to a PFAS-free supply chain. Auditing finds what already went wrong; capability prevents it. Leading here is mostly about teaching, funding and sequencing.

  1. Teach the why before the what. A supplier who understands persistence will find contamination you never thought to ask about. A supplier who only has a checklist will pass the checklist.

  2. Tier the training: two hours of awareness for factory management, one day of technical training for chemists and lab staff, thirty minutes of visual SOP for operators. Bilingual, with local examples.

  3. Build a shared testing pathway: nominated labs, agreed methods, agreed thresholds, negotiated volume pricing — and publish the price so no supplier hides a failure to avoid a cost.

  4. Run one pilot factory end to end — inventory, purge, substitute, test, document — then turn it into a playbook with photographs, real numbers and the mistakes included.

  5. Attach consequence and recognition: publish a readiness scorecard, and give qualified suppliers first refusal on new programmes. Capability must be commercially rewarded or it will not be built.

  6. Open a question channel with a 48-hour answer promise. Every question you receive is a gap in your training material — rewrite the material, don't just answer the email.

  7. Measure readiness, not paperwork: % of BOM lines with material-level chemical data, % of wet sites with a verified purge SOP, % of chemical inventory reconciled to test results, median days to answer a supplier question.

Tip · 小技巧

Ask every supplier one question at the start: "Show me the last chemical you bought, and the document that let you buy it." The answer tells you more about readiness than a full audit report — and it takes four minutes.

The clean formula, the dirty line

You changed the chemistry but not the equipment. Residue in padder baths, coating heads and stenters can carry over for many runs.

"C6 is the safe one"

C6 chemistry is itself restricted in the EU from October 2026. A substitution that buys eighteen months costs you the re-qualification twice.

Total fluorine ≠ PFAS

Fluorine can come from certain dyes, pigments or lab contamination. A high screening result is a reason to investigate, not a conclusion — and not a press release.

The fabric passed, the product didn't

ePTFE membrane, PTFE thread lubricant, fluorinated mould-release on a buckle. Test the assembled article, not only the main material.

Packaging counts as the product

Grease-proof paper and fluorine-treated HDPE containers can both contaminate what's inside them, and both fall inside several state bans.

The claim you cannot defend

"PFAS-free" on a hangtag, in a state with a private right of action, is a lawsuit waiting for a lab report. State what you tested, by which method, to which limit.

Decide
